These Terms and Conditions of Use ("Terms", "Conditions") govern access to and use of the MyProgressFit mobile application (the "App") and our informational website (together, the "Services"), made available by Sergio ("the Owner", "we", "us", "our") to users ("User", "you", or "your").
Please read these Terms carefully before using the App. By downloading, installing, registering for, or using the App, you declare that you have read, understood, and agreed to be bound by these Conditions and our Privacy Policy. If you do not agree to these Terms, you must not use the App.
Age Requirement (18+): Access and use of the App is strictly restricted to individuals aged 18 and older. By registering and creating an account, you represent and warrant that you meet the legal age of majority.
1. Important Notice Regarding Health, Nutrition & Artificial Intelligence
Automated Nutritional Tracking & Planning: MyProgressFit is a digital support tool for nutritional logging, macronutrient estimation, and automated meal and fitness habit planning for personal use. The App does not provide medical or clinical diagnosis, clinical diet therapy, or professional healthcare services.
Does Not Replace Professional Medical Judgment: The contents, calorie estimates, and automated suggestions in the App do not in any case replace individualized clinical advice from licensed physicians, registered dietitians/nutritionists, or other qualified healthcare professionals. Never disregard or delay seeking professional medical advice because of information provided by the App.
Medical Conditions, Allergies, Pregnancy & Eating Disorders: If you suffer from any medical condition, severe food allergies or intolerances, or if you are pregnant or breastfeeding, you must consult a physician before making any changes to your dietary routine.
No Guarantee of Specific Results: Physical responses vary based on individual physiology, consistency, and physical activity. We do not guarantee specific physical results or exact weight milestones.
Review of AI Suggestions: Menu proposals, recipe variations, or automated adjustments generated by Artificial Intelligence features are algorithmic calculations that may contain inaccuracies. Users must carefully review and verify ingredients, gram weights, and allergen notices before preparation and consumption.
2. User Accounts & Registration
To access the App features, you must create an account using an email address or via Google Sign-In authentication.
- Accuracy of Information: You agree to provide true and up-to-date information during registration.
- Security & Custody: You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at support@myprogressfit.com if you detect any unauthorized access to your account.
- Personal Character: Your account is strictly personal and non-transferable.
- Automated Access Prohibited: Accessing the App via bots, scraping scripts, or unauthorized automated systems is strictly prohibited.
3. User-Generated Content & Custom Foods
The App allows you to input and record private information, such as custom foods, recipes, meal notes, body measurements, and progress photos ("User Content").
- Ownership: You retain ownership and all rights to the data and content you input into your account at all times.
- Functional Authorization: By providing User Content, you authorize MyProgressFit to store and process it solely to the extent necessary to provide the Services in accordance with our Privacy Policy.
- Private Nature: Content you enter is strictly private within your profile. Your progress photos are stored encrypted; if you request an AI analysis, the image is sent to the AI provider to perform it, as described in our Privacy Policy.
- Responsibility: You are responsible for the accuracy of nutritional values and descriptions for foods you create manually.
4. Artificial Intelligence (AI) Assisted Features
The App provides Artificial Intelligence tools to help you plan or adjust menus and analyze progress photos:
- AI features operate using advanced models (such as Google Gemini) via secure requests processed through our backend.
- AI suggestions are purely for orientation.
- The user maintains full control and freedom to accept, edit, or reject any proposal generated by the AI.
5. Prohibited Uses
It is expressly prohibited to:
- Use the App for unlawful or fraudulent purposes.
- Decompile, reverse engineer, or attempt to extract source code from the App or its APIs, except where permitted by applicable law.
- Bypass or undermine computer security measures or request rate limits.
- Perform mass data extraction from databases using scraping.
- Sublicense, resell, or commercially exploit the App without express authorization.
6. Intellectual Property & Data Licenses
The intellectual property regime applicable to the App is structured as follows:
- Software & Proprietary Content of MyProgressFit: All intellectual and industrial property rights to the App, source code, graphical interface, design, structure, trademarks, and proprietary recipes are the exclusive property of the Owner or its licensors. A personal, non-exclusive, non-transferable, and revocable license is granted.
- User Content: The user retains ownership of all data, custom recipes, and photos logged in their account.
- Third-Party Data & Open Food Facts: Certain food product information is derived from the open database of Open Food Facts, distributed under the Open Database License (ODbL).
7. Service Availability & Modifications
Services are provided subject to technical availability. We reserve the right to update or modify App features, striving to give notice when changes substantially affect the service.
8. Termination & Account Cancellation
By the User: You can close your account at any time by deleting it directly from the App settings (Profile > Settings > Delete Account) or by emailing support@myprogressfit.com.
By the Owner: We may suspend or terminate access to the App in the event of a material breach of these Terms or fraudulent use of the platform.
Upon account deletion, your right to use the service terminates and your personal data will be deleted in accordance with our Privacy Policy.
9. Limitation of Liability
Nothing in these Terms excludes or limits liability in cases where mandatory consumer protection laws prohibit such exclusion. Subject to applicable law, we are not liable for issues arising from the user's failure to consult qualified healthcare professionals.
10. User Responsibility
The user shall be liable for damages and claims arising from unlawful use of the App or infringement of third-party rights.
11. Force Majeure
Neither party shall be liable for delays or non-performance due to unforeseeable and unavoidable circumstances beyond reasonable control.
12. Applicable Law & Jurisdiction
These Terms are governed by Spanish law. Consumers will benefit from mandatory statutory protections provided by their country of habitual residence.
